Subject: NYSORVA List: Help needed to open roads in the Town of Watson

As it stands, the Town of Watson, Lewis County, NY, is known as the “blackout zone” in that county as it is one of, if not the only town therein that has not legally opened public rights-of-way under their jurisdiction to ATV access by their citizens. Advocates from this and adjacent towns wishing to extend the ATV-legal route system have long struggled with this effort including being dragged into superior court in the matter. Now it is time for us to help tip the scales in the favor of the pro-access advocates. If you are in the region, please consider attending the 12/10/03 meeting noted below. Otherwise, no matter what corner of the state in which you reside, please consider writing a letter to the Board as advised in the notice below.

Thank you,

Alex Ernst

Hi All,

I think the next step needed to be taken is a letter writing campaign to the Watson Town Board members requesting that the roads I have listed in my letter to them be opened. Also, I feel that we need to fill the room with our presence on the night of their next meeting, which is December 10, 2003 @ 7:00 p.m.. If all the ATV clubs in Lewis County could be represented at this meeting, it would be a great help. If anyone would like to speak at this meeting, I suggest that in their letter, they request to have "privilege of the floor". Or you can call the Town Clerk @ 376-3627 and make your request.

If we could get a few hundred people to send them letters telling them which roads we would like to see opened, or show up at the meeting, I think it would help them in their decision making process. Anyone wishing to write should address their letter to: Town of Watson, Attn: Watson Town Board, 6965 Number Four Road, Lowville, New York 13367. I haven't asked for much help on this in the past, but I sure could use it now. If anyone has any questions or suggestions, let me know. Please pass this e-mail on to as many people as you can for assistance in this effort. Thanks in advance for all your help. I've attached a copy of my letter to this e-mail. All the roads are listed in the first paragraph that we would like to see open.

Subject: All Terrain Vehicles

November 5, 2003

Dear Board Members,

I am here tonight to request that you reconsider your decision pertaining to the operation of All Terrain Vehicles on certain roads within the Town of Watson for the purpose of legally accessing existing trails and areas already open to ATV travel. Specifically, I am asking that the following roads be opened by the authority granted to you in accordance with Article 48-C, Section 2405 of the New York State Vehicle and Traffic Law. They are, Moshier Falls Road, Buck Point Road, Stony Lake Road, Bailey Road, Cleveland Lake Road, Beech Mill Pond Road, Sperryville Road, McPhilmy Road, Stillwater Road intersection as shown on the ATV map of the Town of Watson, Sand Pond Road and the Erie Canal Road commencing at the Town line with the Town of Greig and continuing to the intersection of the Number Four Road.

The reason that I am bringing this issue to the Board again is because on several occasions while trying to gain approval of this issue, it’s possible that certain procedures were not legally adhered to by this Board. I feel that because of this, fair consideration may not have been given to my previous requests.

On May 14, 2003, a public hearing was held at 7:30 p.m. at the Watson Town Barn for consideration of enacting Local Law #1-2003 entitled "Town of Watson Local Law Permitting All Terrain Vehicle operation on certain Town highways." There were twenty three residents in attendance and all persons were heard. A motion was made and seconded to hold a special meeting on May 28, 2003 at 7:00 p.m. to vote on the proposed local law.

According to an Affidavit of Publication from the Lowville Journal & Republican dated May 21, 2003, a notice was published stating that, "A special meeting of the Town Board of the Town of Watson will be held on Wednesday, May 28, 2003 at 7:00 p.m. at the Town Conference Room." The minutes of the May 28, 2003 meeting state, "A special meeting was held by the Town Board of the Town of Watson on the above date to vote on Local Law #1-2003, entitled "TOWN OF WATSON LOCAL LAW PERMITTING ALL-TERRAIN VEHICLE OPERATION ON CERTAIN TOWN HIGHWAYS." Thirty six residents were present along with the full board. After the minutes were read and approved from the May 14, 2003 meeting, no vote was immediately taken on the issue that the meeting had specifically been called for. Instead, according to the minutes, "The Board continued to let the public be heard." "A petition was submitted along with a comment paper from those residents on the Erie Canal Road."

This special meeting was called specifically to vote on the issue at hand. No notice was given to the public that there would be any further discussion on the issue. The public hearing had already been held on May 14, 2003, at which time the people were given the opportunity to voice their opinions. I feel it was unfair of the board to allow further discussion of the issue to be voted on that night and to accept a petition and comment paper after the fact. Following approximately an hour of discussion, the Town Board then voted "No" to Local Law #1-2003. In accordance with Public Officers Law, Article 7, Open Meetings Law, Section 100, Legislative declaration states that, "It is essential to the maintenance of a democratic society that the public business be performed in an open and public manner and that the citizens of this state be fully aware of and able to observe the performance of public officials and attend and listen to the deliberations and decisions that go into the making of public policy."

According to an Affidavit of Publication by the Lowville Journal & Republican dated August 13, 2003, a notice was published stating that, "On Wednesday August 27, 2003 the Town Board of the Town of Watson will hold a special meeting at 7:00 p.m. at the Town’s Conference Room. Two referendums will be discussed: 1. ATV travel on certain town roads. 2. Certain Town officer’s being appointed instead of elected."

After calling the special meeting of August 27, 2003 to order, the minutes from the August 6, 2003 meeting were read and approved with one correction. As advertised, the Board discussed and accepted a legal petition to open all town roads to ATV’s, discussed the issue of the highway superintendent and voted to have both issues put on the November 4, 2003 ballot. The Board then continued with issues that were not advertised or pertained to the purpose of the special meeting and adjourned at 8:00 p.m. According to Robert’s Rules of Order, Article VIII: Section 44 reads, "Notice of a special meeting must include the items of business to be considered at the meeting, and no other items may be considered."

At a term of the Supreme Court of the State of New York, held in and for the County of Lewis, at Lowville New York on October 30, 2003. The Honorable Joseph D. McGuire, in the matter of the application of Lawrence Manion, George R. Davis and Janette M. Peek vs. Town of Watson and Virgil E. Taylor, as Supervisor of the Town of Watson, ordered that proposition number two regarding ATV’s be removed from the ballot. As a general rule, a municipality may not submit a local law to the vote of the electors in the municipality without some specific legal authorization. The Judge also stated that the Court does not resolve whether ATV travel may be permitted on town roads in the Town of Watson and that no opinion is rendered with respect to the local law.

It is for the above reasons that I once again respectfully request that this Board consider opening the town roads that I have listed to legally access trails and areas already open to ATV travel. I feel my request specifically conforms with the requirements of Article 48-C, Section 2405, which states, whereas a governmental agency with respect to highways under its jurisdiction may designate and post any such public highway or portion thereof as open for travel by ATV’s when in the determination of the governmental agency concerned, it is otherwise impossible for ATV’s to gain access to areas or trails adjacent to the highway. If this Board will explain to me where my request does not meet the requirements of Article 48-C, Section 2405, I will gladly drop this issue. Thank you once again for you time and consideration of this matter.

Respectfully submitted,

Floyd J. Rivers

HAPPY VETERANS DAY to all the fine men and women who have served and are serving their country so well..........GOD SPEED to all those still with us and may all those folks who have moved on to meet their maker...........may YOU rest in peace.

this past election day in ny state did not boude very well for the politicians that were/are pro atv. seems like a lot of the voting public are not atv riders up here in the north country. so...riders you get what you reap.....if you don't vote for the people that represent your way of thinking then less and less trails is what's in store for all of us.............as usual, the tree huggers are well organized, well healed and vote...............maybe next time!....that's four years from now!.................still... you can keep up the pressure on the state level of senators and representatives in albany to get the state to live up to what it has already promised and been paid for.....a state sponsored trail system..................canada every state around new york has a state/federal atv trail system in place. they work, they are profitable and it seems that most folks both pro and con to atv's like what's going on.
GOOD NEWS.........the political grapevine says that RUDY GUILANI will run for the governors seat next state election.....gov. pataki will take the senate seat away from clinton and our good friend rick lazio from long island will become lt. governor................oh yeah.............

NOVEMBER 4th....ELECTION DAY....THE AMERICAN WAY.......due your duty, get yourself, your family, friend and neighbors out and "V O T E"...............no progress on local ATV issues, town of watson elected officials stuck at 50/50 on the ATV question...........new DOT approved ATV's that will be street legal "4 wheel motorcycle" will solve some of the problems but real trails will have to come from albany legislation...........keep the pressure up on our elected officials for pro-equal access to roads and public lands for all new yorkers............
the stillwater reservoir is filling up like it was spring. only 4.5 feet from completely full! right now we should be down at least 12+ feet. we have less than 2 months before it freezes tight. this time last year we had 1.5 feet of snow on the ground, this morning it's 38f so we're getting close...that's it for the local news, now, the national news.......the economy is on the up-swing, the dow will hit 10k and the nasdac will crest 2k before the end of this year.......... the democrates are on the run and the republicans got their feet firmly on the ground. more jobs and less chaous in iraq and the big picture will look pretty good! new housing starts are thru the roof....interest rates are at a all time low. President Bush's tax cuts are kicking in nicely and with a robust economy the deficit will evaporate over the next 5 years and with iraq towing the line we will have plenty of oil to keep the world economies machinery running smoothly.
this is the way i see it!......how about you?.....your comments are welcome via the message board.....if you dare!

ATTENTION STILLWATER RESERVOIR AND BEAVER RIVER STATION RESIDENTS............a select number of residents and property owners in stillwater have recieved a letter from the dec to cease and deassist using certain lands and waters that belong to the state of new york. this would be land between your propety line and the high water level normally seen in late spring(1679.6). this might also include dock(s) that float on the water in front of your summer cottage or camp. the drop dead date is 10/16/03. the dec is now saying that they are receiving their marching orders from the governors office. the time to act is now for those folks who have already recieved this letter. for those folks who have not recieved this letter, you will, it's just a matter of time. you may contact the stillwater shop at 315-376-2110 or ms. judy drabicki, esq at 315-639-4949 for additional info. we/you are in district 50 and senator james seward at 518-455-3131 may be contacted and we are also in district 113 and assembleman marc butler may be reached at 518-455-5393. should you lose your ability to float your dock and have access to the reservoir via your propety, then the real estate value of your propert will most certainly go down. certain properties that have fisher deeds/titles still in place and some properties with riparian rights may not be effected by this state action. it most certainly pays to check. the dec has deployed serving just a few properties at a time....it's called divide and conquer.
the residents of the great sacandaga reservoir had a similar situation about 10 years back and they found a resolution but had to sue the state first. also, HRBRRD will tell you that they pay the taxes on the property from high water mark and down and do not have rules or regulations on floating docks under 100 feet in lenght. there's more to this than meets the eye.......more later

HERE'S THE PROBLEM IN A NUT SHELL...THE DOWN STATE PEOPLE THAT SPONSOR THE GREEN HEADS ARE WELL EDUCATED, WELL ORGANIZED AND WELL HEALED..AND THEY SLEEP BETTER AT NIGHT KNOWING THAT THE WOODS WILL STILL BE HERE "IF" AND "WHEN" THEY SHOW UP..I CALL IT "THE TEDDY ROOSEVELT SYNDROME"........
ON THE OTHER HAND....THE EQUAL ACCESS PUBLIC TEND TO BE BLUE COLLAR FOLKS, OJT EDUCATED, GENERALLY NOT WELL ORGANIZED COLLECTIVELY, AND ON AVERAGE EARN LESS THAN THE DOWNSTATE BRAIN SURGEONS. THAT'S THE DISADVANTAGE.........HOWEVER, HERE'S THE ADVANTAGE....POPULATION WISE...THERE'S A WHOLE LOT MORE OF US THEN THERE ARE OF THEM....BIG TIME...AND COLLECTIVELY A LOT MORE MONEY...WE MUST ORGANIZE.....MR. ALEX ERNST OF NYSORVA AND MR. GENE TERRY OF ADIRONDACK CONSERVATION COUNCIL SAID IT BEST..."WE MUST COLLECTIVELY ORGANIZE ALL THE SMALLER FACTIONS AND CLUBS THAT ARE ADVOCATES OF THE EQUAL ACCESS PUBLIC".....INTO ONE POWERFUL ORGANIZATION THAT CAN HIRE LOBBYISTS AND LITAGATING ATTORNY'S TO FORCE THE STATE INTO EQUAL ACCESS AND USE OF ALL STATE LANDS. Mr. Gene Terry president of the ADIRONDACK CONSERVATION COUNCIL and i had a wonderful conversation today. we came to the conclusion that IF we could be successful in bringing all the convaluted pro-equal use factions together in the state of new york, meaning snowmobilers, hunters/trappers, atv'ers, anglers outdoor sportsmen in general the disabled that enjoy motorized access without confrontation by any state employee or green head would be impressive. albany would have no choice and discrimination would be eliminated.

i got to fix the rocky rough ramp down to our dock and replace it with a nice smooth pebble strewn path. next the paver bricks will be going in to allow people in wheel chairs to safely make their way down to the waters edge....nice.
on the other side of town, "the chetster" got his granite steps in for his elderly father. they go from the top of his property all the way down to almost the waters edge.....nice....real nice............
the folks from BROOKSIDE II are burning down the phone lines trying to russel up more support for their "ATV HATE" project.....funny side story....while the ranger was away on vacation, at least 2 dozen ATV's came and went without a hitch and almost all the locals never had a clue. it's also ironic that the only serious ATV accident ever to occur in the stillwater area was on the current rangers watch.........when terry p. was running the show here in stillwater....never a problem and the locals back then just didn't give a damn........oh'well........

GOOD NEWS.............thanks to SUPERVISOR MOORE AND PAT PATTERSON OF PATS USED AUTO'S....stillwater is rid of all the BRS junks...............that got way-laid in stillwater waiting for the flat-beds to show up...........all is well now..........thanks to one and all....................
rumors are flying high about the concrete cause-way from stillwater to 6 mile point.....is it possible that NYS would spend $12 million to go about 1.5 mile...........that's a whole lot more than the $1 million dollars a mile for the railroad R&R (no pund intended). i guess we will have to wait and see!

- Monday, July 28, 2003 at 17:25:00 (PDT)
WHAT A MESS.............finally the town of BEAVER RIVER STATION is cleaning up and removing their old junk cars that people have been taking up for years. see, if they had been taking up ATV's the TOWN of WEBB wouldn't have to bear the cost to remove these old junks.....since ATV's last forever, don't ya know!
THE HAMLET OF STILLWATER RESERVOIR looks a bit shabby at the moment with all this rolling litter all over the place....fall would have been a little better time to do this dirty deed. hopefully the junk yard folks will be showing up soon to pull these old detroit monsters out of here...............see...if they where ATV's they would not take up so much space and probably the local kids would have already grabbed them to rebuild..................

hello from stillwater.........bad news from the hamlet..........terry and diane perkins......dec ranger for more than 30 years lost their home on perkins island to fire..................possible cause was a malfunction in the wood boiler that set the shed a blaze which in turn ignited the house...........nieghbors and fireman where able to save the out-buildings and keep the woods from catching fire............a few items were rescued but most was lost.......please keep these wonderful people in your prayers and should you want to help in any way contact the stillwater shop at 315.376.2110 for more info..........................on a more local mundane note.........the dirt part of the boat ramp at waters edge is very dangerous..........4-wheel drive trucks and tractors are getting stuck because of the very loose goooooey sand-muckamuck stuff down there.........local authorities are promising to bring in some crusher-run rip rap rock to save the day.........the APA says no can do but we say....damn the torpedoes...full speed ahead!!!!!!!!...........dennis lee and his lovely wife andy made it up to big burnt lake in a pump-boat which needs very little water to get by....prop-driven boat just could not do it............the weathers been great and finally some folks have shown up to take in the areas beauty.............waters down 22 feet with about 6 more feet to go.......construction on the dam will begin soon and we locals are looking forward to getting started.............that's all for now.....more later...........stay tuned.....and for all the folks who showed up saturday night at the hotel for many reasons............thank-you all very much........it did not go un-noticed.............rudy...........

- Monday, July 30, 2001 at 06:23:30 (PDT)
hello stillwater fans.............terry perkins has reported in and tells me that he and his party by boat made it all the way up to little rapids and the culvert just the other day.........of course he paid close and strict attention to the river channel and manuvered his way around many rocks and stumps and other booogie-men........he said that picnic point was the trickiest...........the boat ramp is now at least 40 feet from the concrete to waters edge........the sand and gravel is hard/compact and people have been moving the big rocks out of the way.................the neccessary dam road has been officially closed to tourist traffic which means that camping below the dam is no longer available.......backup camping for the area will now be the basket factory road area located about 4.5 miles back off the stillwater road haeding towards lowville.....check the map on our websiet for more details....or call us at 315.376.2110....................our store is open 7 days from 8am/7pm with everything you might need....just bring money and we'll do the rest...........thx......rudy.............

- Thursday, July 19, 2001 at 23:03:10 (PDT)
hello from the stillwater shop................as of this moment the water level is exactly 15.2 feet down from high water mark, that is where the trees stop and the reservoir begins............the boat ramp is at least 20 away from waters edge with hard sand and gravel making boat launching not hard at all, thank goodnesss.............what's left of our front bay is about 4 feet of water left at the boat launch area...........this will be gone in about 7 days from now at the current drop rate.............when this occurs the boat ramp will be 100 feet or more from waters edge and we're hopeful the dec/tow highway people will extend the ramp with some kind of road repair material....................at this time getting past picnic point is a challenge with rocks and stumps making the river channel pretty slim and the water is no more than two feet deep......with this in mind about one half the campsites will be tough to get to........check out the map/direction button for details and use the enlarge option............the weather will be sunny and warm till next monday at least.........that's all for now......stay tuned......more later........thx..........rudy............ps...my family moves into the new house maybe this weekend after almost two years of construction....we're still not finished but gain'n.............

- Wednesday, July 18, 2001 at 00:09:38 (PDT)
hello from stillwater..............the water is dropping like a lead ballon and the boat ramp is now about 10 feet ago...........launching is still possible with 4 wheel drive, but be careful in the wet sand.............the reservoir is down about 16 feet and their is still plenty of water around.....four more feet and our little front bay will be gone and the boat launch will be 300 feet away from normal...........brs people are using the six mile road often now and the thompsons just moved their big dock over there today................summer been kind of slow and will pick up when the real summer weather kicks in............jerry from rapshaw says he has had only one cancellation all season and is pretty busy............stay tuned ....more later...........thx...........rudy.......

- Friday, July 13, 2001 at 01:54:32 (PDT)
happy july 4th to all our friends and enemies and all those who call themselves patriots........the water level is dropping pretty fast now because of the natural taper of the sides of the reservoir.....smaller foot-print= less water to loose each day when measured in inches down per day........sound pretty complicated, huh!!!!!!!! still in all the job of repairing the dam will go on and let's all pray it stays on schdule unlike my b+b/home project which keeps slipping for various no-good reasons.......well anyway it looks like summer activities has begun here in stillwater......kids chewing gum...riding bicycles...looking for more gum to chew and asking stupid kid questions......like,"why is the water down so low"..............the boating is still good and we are keeping our rentals in for longer than we thought.......this is a whole new experience for all of us.................the store is open 7 days 8am/7pm sun/thur and til 8pm fri/sat.....diary bar always open with atm inside for your convenience.......stop in...have a cone....and sit in the porch and enjoy..........that's all for now.......stay tuned...more later.......thx........rudy.........

- Wednesday, July 04, 2001 at 02:08:54 (PDT)
your stillwater reporter has been busy trying very hard to get his family into their new home.....hopefully two more weeks should do it......we'll see.........the northern lights B+B aka the rudolph's new home will open this summer for test runs with friends and family and should be ready this fall for reservations........we'll see....................lee construction has found a large supply of rocks on the buckley camp porch rebuild project...stop by i'm sure they have a few to spare......more and more camps are opening up as the summer progresses.......but i think it will still be a slow summer because of the water level being down....on the other hand it should be a great time for non-residents to see the area as it's not been seen in 40 years.........the canoeing and kayacking will be great........camping will be good to with really big beaches to play on..........the store is open 7 days from 8am/7pm mon/thurs and till 8pm fri/sat............that's all for now....stay tuned more later............thx..........rudy.........

hello from your favorite local yocal, yes, that's right, rudy from the stillwater shop..............terry perkins will soon be a contributor to "the news" and i'm sure will have lots of stories to tell you boys and girls...................

water levels are dropping much faster now because the reservoir is physically smaller, about 3" per night. two docks are high and dry with four to go.........lots and lots of new islands out there and the fishing is superb...........the beachs are big and pure white, what a sight.......canoeing and kayacking is excellant and the bugs are losing the battle, much better this year than last...it's raining right now but the weatherman tells us that saturday and sunday will be bright & sunny and a little cooler.........by the by jerry from rapshaw club fame has become a big tree expert.....just ask him and he'll tell ya......he also told me that rapshaw was going to get a bigger tracktor.....say around a cat D9.....................the northern lights B+B is coming to stillwater this summer........check out the photo gallery button, on our web-site, for some close up shots of the place......the dec has been replaced by the apa with regards to shooting holes in our sign, fortunately we know a good sign maker, her name is ms. judy drabicki,esq....attorney extraordinaire..............my wife and i moved up here to get away from the down state cow crap only to find 50,000 cows manuring every day and night and day and night and day and so on and so on...............oh well....life will go on, won't it.............thx........stay tuned......more later.............rudy........

- Saturday, June 23, 2001 at 00:15:15 (PDT)
hello to all from stillwater...............thanks gary...........hey, there's a rumor going-round that because the water is going down down down down that the stillwater area will be closed........sounds like something the dec would like........well, anyway, the rumor is not true and there's plenty to do........power boating is still good ,just watch out for the usual boogie-men and what-not and because the water is down the fishing has been excellant..................the flying flesh eaters are doing well and have and will chase the unprepared pikers right out of the woods......fly dope everybody fly dope..........we have plenty in the store....bring money..........talk about hazey hot and humid....saturday i thaught i was at the jersey shore....ahhhhhhhh...oh no not the jersey shore.........the front came through about 3pm and the temp dropped 10 degrees in 10 minutes.......lightening struck a big pine on rapshaw is. about the sane time and split it right down the middle top to bottom...i'm talking 48" dia. and at least 80 ft....blew the roots up to......what a mess!!!!!!!!!!! today, sunday, happy fathers day to all the fathers, it's sunny with a few clouds puffing by and generally very nice and sunny for the rest of the week.................the store is now open 7 days from 8am/8pm with the atm inside for your convenience.............the yummy dairy bar is good and cold with lots of treats for boys and girls..................stay tuned..... more later.....thx.........rudy...........

- Sunday, June 17, 2001 at 05:19:51 (PDT)
welcome to the first ever stillwater news

for sue, power boating this season on the reservoir will be different because the water will be very low due to a dam maint. project underway this year. select dam maint. button for more detail on this subject. there may come a time this season where getting to certain campsites will require a little hiking. canoeing and kayacking will be the best way to get around here while the water is low.

the flying bug fest along with the adirondack macaraina dance is well underway here and hopefully will end with us humans as victors.............as usual...we will have to wait and see!!!!!!!!!!!!!!!!!!!!

the weather was great until yesterdays heavy rain storm........the rest of the week will be lousy but the weekend looks a lot brighter.........

the store is open 7 days from 8am/7pm monday thru thursday and open til 8pm fri/sat nights......

atm inside for your convenience and the dairy bar has lots of very good ice cream on hand to satisfy every wish

stay tuned......more later...........thx.........rudy...
